Terms of Service

These Terms of Service govern your use of Tixlah, including account access, event registration, payment processing, and participant responsibilities on our platform.

Definitions

In these Terms of Service, the following terms have the meanings set out below:

  • Platform refers to the Tixlah website, mobile site, and any associated services operated by EC Pixels Asia Sdn. Bhd.
  • Organizer refers to any individual or entity that creates, manages, or hosts an event listed on the Platform.
  • Participant refers to any individual who browses, registers for, or attends an event through the Platform.
  • Registration refers to the process of securing a place at an event, including any associated payment.
  • Event refers to any activity, gathering, race, or experience listed on the Platform by an Organizer.
  • Content refers to text, images, logos, and other materials submitted to or displayed on the Platform.

Acceptance

By accessing or using Tixlah, you agree to these Terms of Service, our Privacy Policy, our PDPA Notice, and any additional terms presented during event registration or payment. If you do not agree, do not use the Platform.

Our Role

Tixlah is a technology platform that connects Organizers with Participants. We provide registration, payment processing, and event management tools. We are not the creator, host, or operator of any event listed on the Platform. Each Organizer is independently responsible for the accuracy of event details, compliance with applicable laws, the safety and conduct of their event, and the fulfillment of their obligations to Participants.

Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to create an account or use the Platform. If you are under 18, you may only register for events with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. By using the Platform, you represent that you meet these eligibility requirements.

Account Registration

You are responsible for providing accurate account information, protecting your login credentials, and ensuring that the contact details connected to your account remain current. You must notify us promptly if you believe your account has been compromised. You are responsible for all activity that occurs under your account.

Event Registration & Payment

Registrations are subject to event availability, Organizer rules, eligibility requirements, and successful payment confirmation. A slot is not guaranteed until the Platform confirms the registration or payment status. Payments are processed through third-party payment providers and are subject to their respective terms and conditions. Platform service fees, where applicable, are disclosed at checkout before payment is confirmed.

Cancellation & Refunds

Refunds, transfers, and cancellation rights depend on the policies set by each Organizer unless otherwise required by law. Tixlah may assist with operational handling but does not override Organizer policies without authorization. For full details, please refer to our Refund Policy.

User Conduct

You agree not to engage in any of the following prohibited activities:

  • Misusing the Platform or interfering with its operation, security, or integrity
  • Impersonating another person or misrepresenting your identity or affiliation
  • Attempting unauthorized access to any part of the Platform, its systems, or other users' accounts
  • Using automated tools, bots, or scripts to scrape, crawl, or extract data from the Platform
  • Interfering with or disrupting other users' registrations or event participation
  • Submitting false, misleading, or fraudulent information during registration or checkout
  • Reselling or transferring event registrations for commercial gain without Organizer authorization
  • Uploading or transmitting malware, viruses, or other harmful code
  • Using the Platform for any unlawful purpose or in violation of any applicable law

User Content

You retain ownership of any content you submit to the Platform, including profile information, event reviews, or feedback. By submitting content, you grant Tixlah a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content solely for the purpose of operating, promoting, and improving the Platform. You represent that you have the necessary rights to grant this license and that your content does not infringe any third party's rights or violate any applicable law.

Intellectual Property

The Platform, including its design, logo, software, text, graphics, and other content, is protected by applicable intellectual property laws and is owned by or licensed to EC Pixels Asia Sdn. Bhd. You may not copy, modify, distribute, sell, or create derivative works based on the Platform or its content without our prior written consent. Event names, logos, and Organizer materials remain the property of their respective owners.

Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not guarantee the accuracy, completeness, or reliability of any event information, Organizer content, or third-party services accessible through the Platform.

Limitation of Liability

To the maximum extent permitted by law, Tixlah and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, event changes, Organizer actions, payment interruptions, or any other matter related to the services. Our total liability for any claim arising under these Terms shall not exceed the total fees paid by you directly to Tixlah in the twelve (12) months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Tixlah, EC Pixels Asia Sdn. Bhd., and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Platform, your violation of any applicable law, or any content you submit through the Platform.

Term & Termination

These Terms take effect when you first access or use the Platform and remain in effect until terminated. You may terminate your account at any time by contacting us at support@tixlah.com. We may suspend or terminate your access to the Platform at any time, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or if continued access poses a risk to the Platform or other users. Upon termination, your right to use the Platform ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, disclaimer of warranties, and governing law survive termination.

Force Majeure

Tixlah shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, epidemics, government orders or restrictions, civil unrest, internet or telecommunications failures, power outages, or acts of terrorism. Event cancellations or changes caused by force majeure events are subject to the applicable Organizer's policies and our Refund Policy.

Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least fourteen (14) days' advance notice by posting the updated Terms on the Platform and, where practicable, notifying you by email. Non-material changes take effect immediately upon posting. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Platform and contact us to close your account.

Dispute Resolution

If you have a dispute with Tixlah, we encourage you to first contact us at support@tixlah.com so we can try to resolve the matter informally. If the dispute is not resolved within thirty (30) days of your initial contact, either party may pursue formal resolution through the courts of Malaysia as described in the Governing Law section below.

Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Malaysia.

General

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. These Terms, together with our Privacy Policy, PDPA Notice, and Refund Policy, constitute the entire agreement between you and Tixlah regarding the use of the Platform. You may not assign or transfer your rights under these Terms without our prior written consent. Tixlah may assign its rights and obligations under these Terms without restriction.
